Family Files Lawsuit in Fatal Santa Monica Airport Crash |

By Lookout Staff November 7, 2013 -- The family of one of the victims killed in a plane crash at Santa Monica Airport in September is seeking damages from the estate of the plane’s pilot. According to documents filed with the Los Angeles Superior Court Tuesday, Charles Dupont, Elliot Dupont and Jackson Dupont are seeking compensation from the estate of Morley Builders CEO, the late Mark Benjamin, who was piloting the plane that crashed on September 29. The three plaintiffs, reports say, are the sons of 53-year-old Kyla Dupont, who was killed along with Benjamin and two others in the crash. While the National Transportation Safety Board has yet to determine the actual cause of the crash, the suit lays the blame for the accident on Benjamin, a seasoned pilot. The suit alleges that Benjamin did not act "reasonably in the ownership of the plane" by failing to keep the Cessna Citation maintained. It also alleges that Benjamin was at fault for failing to maintain control of the plane when it landed. According to the NTSB’s initial report, issued in October, there were no reported equipment failures and there was no debris on the runway. The report also cites testimony by witnesses who say that the plane landed safely in the late afternoon that Sunday after the flight Hailey, Idaho. Shortly after it landed, the report says, the plane veered off the runway and crashed into a nearby hangar. Dupont, Benjamin, his 26-year-old son, Lucas and Lucas’ girlfriend, 28-year-old Lauren Winkler, were all killed in the resulting fire. NTSB authorities are expected to make a final determination sometime in the next couple of months, but until then, the cause of the accident remains a mystery. |
